In accordance with the Italian national legislation (Decreto
Legislativo 3 febbraio 2011, n. 71 “Ordinamento e funzioni degli Uffici consolari” – Art. 28 – Funzioni notarili), the Head of the Consular Office exercises the functions of a notary exclusively for Italian citizens who live abroad permanently or temporarily.
The only exceptions are if a deed must be signed by both a foreign and Italian citizen, as well as Atti Notori for marriage
to be contracted in Italy by Australian or US citizens.
The Consulate General of Italy in Sydney prepares documents and provides many of the services that, in Italy, would require the intervention of a notary, such as general and special power of attorneys, atti notori, signature authentication, dichiarazioni sostitutive di atti di notorietà, etc. However, the Office cannot provide any legal assistance/advice.
In any case, there are local lawyers and public notaries
able to draw up notarial deeds in Italian and to offer legal advice to those who need it, even towards citizens of other nationalities. It will always be the applicant’s responsibility to provide for the legalization of the same deed with an Apostille and for the translation of the power of attorney, if drawn up
in English.
The Consulate Notary Office will assist in preparing the following documents:
- General and special power of attorney (proxies);
- Special Power of attorney for litigation;
- Revocation of Power of attorney;
- Atto Notorio;
- Affidavits;
- Deed of renunciation to inheritance;
- Copy of notary deeds.

ADMINISTRATIVE NOTIFICATIONS
Please note that notifications of administrative acts to Italian citizens and foreigners residing in NSW may be made by the Italian Public Administration Offices by direct mailing to the addressee of the documents by registered mail with advice of receipt (AR).
It is advisable to opt for an international mailing method that includes a tracking code and the return of AR card.
