Registering civil union between persons of the same gender

The civil union between persons of the same gender of Italian citizens who married in Australia, to have effect in Italy, must be registered by the relevant Italian Municipality Registry.

Same-sex marriage in Australia has been legal since 9 December 2017.

To register the civil union (same-sex marriage), the following documents must be mailed to one of  these addresses  or handed in at the reception of this Consulate General:

  1. Certificate registration form;
  2. The original Marriage certificate issued by the Registry of Births, Deaths and Marriages, legalized by means of the Apostille (issued by the Department of Foreign Affairs and Trade);
  3. A translation of the marriage certificate into Italian, either by an official NAATI translator or independently. If you opt for the independent translation, please note that it must be fully in conformity with the original text. Should this Office find any discrepancies with respect to the English text or lack of elements, all the documentation will be returned to the applicant for completion; please note that the apostille DOESN’T have to be translated.
  4. photocopy of the Italian identity card or Italian passport of the Italian citizen(s), photocopy of the passport of the foreign citizen (if the spouses are not both Italian)

 

PLEASE NOTE: the original certificates will be retained by the Consulate for recordkeeping.
