Useful contacts and links<\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong> Legislation<\/strong><\/li>\n<\/ol>\n<p>Those who apply for citizenship by marriage or civil partnership must be acquainted with the duties towards the Italian Republic, first among them adherence to the national values and irreproachable conduct.<br \/>\nThe acquisition of Italian citizenship by marriage by a foreign national or stateless person who married an Italian national on or after 27th April 1983 is currently governed by Law no. 91 of 5th February 1992 (articles 5,6, 7 and 8) and subsequent amendments.<br \/>\nItalian citizenship applications may also be submitted by a foreign national who has entered into a civil partnership with an Italian national. The civil partnership must have been registered in the Registers of Civil Status of the Italian \u201cComune\u201d &#8211; Town Hall \u2013 (Legislative Decrees 5,6,and 7\/2017).<br \/>\nThe foreign spouse\/civil partner can acquire Italian citizenship upon request provided they satisfy the legal requirements, as outlined below.<br \/>\nRelevant legislation:<\/p>\n<ul>\n<li>Law no. 123 of 21st April 1983<\/li>\n<li>Law no. 91 of 5th February 1992<\/li>\n<li>Legislative decrees no. 5, 6 and 7 of 19th January 2017<\/li>\n<li>Decree Law no. 113 of 4th October 2018 (so-called \u201cSafety Decree\u201d) converted by Law no. 132 of 1st December 2018<\/li>\n<li>Decree Law no. 130 of 21st October 2020, converted by Law no. 173 of 18th December 2020<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li><strong> Requirements for the acquisition of Italian citizenship<\/strong><\/li>\n<\/ol>\n<ul>\n<li><strong>Residence in the consular district<\/strong>:\n<ul>\n<li>The applicant will have to submit their application to the diplomatic\/consular mission covering the area of their long term residence;<\/li>\n<li>The Italian spouse\/civil partner must be resident and legally registered in the A.I.R.E. (Anagrafe degli Italiani Residenti all\u2019Estero \u2013 Register of Italians residing abroad) of the relevant consular district and cohabiting at the same address of the citizenship applicant. Conversely, they will need to provide documentation proving the reason (e.g. work, children\u2019s schooling, medical care or other) justifying the need for separate domicile;<\/li>\n<\/ul>\n<\/li>\n<li><strong>Submission date:<\/strong> the application can be submitted three years after the marriage\/civil partnership if the spouse is an Italian national iure sanguinis; in case of naturalisation after the marriage, the three years start from the date of naturalisation of the spouse. The three years are reduced to one year and a half in case of children born or adopted by the spouses (minors or over 18);<\/li>\n<li><strong>Registration of the marriage\/civil partnership:<\/strong>\u00a0if it occurred abroad, it must have been registered at the \u201ccomune\u201d (town hall) in Italy;<\/li>\n<li><strong>Validity<\/strong>\u00a0of the marriage\/civil partnership and stability of the marriage\/civil partnership until the decree granting citizenship has been finalised. For the purposes of granting Italian citizenship, at the date of adoption of the decree no dissolution, annulment or termination of the civil effects of the marriage\/civil partnership (legal separation, divorce, death of the spouse or civil partner) must have occurred;<\/li>\n<li><strong>Absence<\/strong>\u00a0of convicting sentences by the Italian judicial authorities for offences that carry a sentence of more than three years\u2019 imprisonment;<\/li>\n<li><strong>Absence<\/strong>\u00a0of convicting sentences by the foreign judicial authorities that carry a sentence of more than one year for non-political offences;<\/li>\n<li><strong>Absence<\/strong>\u00a0of convictions for offences against the State;<\/li>\n<li><strong>Absence<\/strong>\u00a0of impediments for the security of the Italian Republic;<\/li>\n<li><strong>Knowledge<\/strong>\u00a0of the Italian language at least at B1 level of the Common European Reference Framework;<\/li>\n<li><strong>Payment<\/strong>\u00a0of taxes and fees listed in the Documents and fees section.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><strong> DOCUMENTS required for the citizenship application<\/strong><\/li>\n<li><strong> Original Full birth certificate or equivalent<\/strong>: issued no more than six months previously by the country in which the applicant was born, which must include all the personal details (including father\u2019s and mother\u2019s details), duly legalised\/apostilled and translated into Italian. Either the certified translator or the competent Consulate will have to declare the conformity of the translation, which must be apostilled or legalized by the competent authority. As regards Australia birth certificates, the applicant must request an original copy from the\u00a0<a href=\"https:\/\/www.nsw.gov.au\/births-deaths-marriages\"><strong>Registry of Death Births &amp; Marriage<\/strong><\/a>. This must be apostilled by the\u00a0<a href=\"https:\/\/www.dfat.gov.au\/about-us\/our-services\/apostilles-authentications-certificates-of-no-impediment-to-marriage\/Pages\/apostilles-authentications-and-certificates-of-no-impediment-to-marriage\"><strong>Department of Foreign Affairs &amp; Trade<\/strong><\/a>and\u00a0<a href=\"https:\/\/conssydney.esteri.it\/consolato_sydney\/en\/i-servizi\/per-i-cittadini\/elenchi.html\"><strong>translated<\/strong><\/a> into Italian.\u00a0Also the translation must be apostilled.<\/li>\n<\/ol>\n<p><strong>PLEASE NOTE: if the conformity hasn\u2019t been declared by the certified translator, the applicant will have to come to the Consulate to finalize the document BEFORE applying through the Portal.<\/strong><\/p>\n<ol start=\"2\">\n<li><strong> Original Criminal Record<\/strong>of the country of origin and any third countries of residence (from the age of 14) \u2013 except Italy \u2013 and of the countries of which the applicant is a citizen, issued no more than six months prior to the application date, duly legalised\/apostilled and translated into Italian.\u00a0Either the certified translator or the competent Consulate will have to declare the conformity of the translation, which must be apostilled or legalized by the competent authority.\u00a0<strong>AUSTRALIA POLICE CHECK<\/strong>can be obtained by making a request to the\u00a0<a href=\"https:\/\/www.afp.gov.au\/what-we-do\/services\/criminal-records\/national-police-checks\"><strong>Australian Federal Police<\/strong><\/a>\u00a0(ONLY), in all the names the applicant has been known. The police certificate will need to be apostilled by the\u00a0<a href=\"https:\/\/www.dfat.gov.au\/about-us\/our-services\/apostilles-authentications-certificates-of-no-impediment-to-marriage\/Pages\/apostilles-authentications-and-certificates-of-no-impediment-to-marriage\"><strong>Department of Foreign Affairs &amp; Trade<\/strong><\/a>\u00a0and\u00a0<a href=\"https:\/\/conssydney.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/lists\/\"><strong>translated<\/strong><\/a>\u00a0into Italian.\u00a0Also the translation must be apostilled.<\/li>\n<\/ol>\n<p><strong>PLEASE NOTE: if the conformity hasn\u2019t been declared by the certified translator, the applicant will have to come to the Consulate to finalize the document BEFORE applying through the Portal.<\/strong><\/p>\n<ol start=\"3\">\n<li><strong>Payment receipt of Euro 250.00<\/strong>to the Ministero dell\u2019Interno (Ministry of the Interior), in the ways specified in the \u201cFees\u201d section;<\/li>\n<li><strong> Identity document:<\/strong>photocopy of valid passport (pages with personal details, photo, date of issue and expiry date);<\/li>\n<li><strong> Copy of the full marriage certificate<\/strong>or \u201cestratto per riassunto del registro dei matrimoni\u201d (extract of marriage certificate), to be requested from the relevant Italian \u201ccomune\u201d (town hall) in which it is registered, issued no more than the six months prior to the application date. This document can be uploaded when submitting the application under \u201cgeneric document\u201d and will need to be presented when the applicant is invited by the Consular office. ATTENTION! \u201cMarriage Certificates\u201d will not be accepted.<\/li>\n<\/ol>\n<p><strong>PLEASE NOTE:<\/strong>\u00a0If the applicant is an EU national, they may submit a self-certification instead of the marriage certificate, \u201cstato di famiglia\u201d (certificate listing the family members living at the same address) and citizenship certificate of the spouse\/civil partner (Presidential Decree 445\/2000);<\/p>\n<ol start=\"6\">\n<li><strong> Certificate of Italian language knowledge<\/strong>at least at B1 level of the Common European Reference Framework or a qualification issued by a public or private educational institution recognised by the Italian Ministry of Education, Universities and Research and the Italian Ministry of Foreign Affairs and International Cooperation.\u2028The CLIQ (Certificazione Lingua Italiana di Qualit\u00e0 \u2013 Quality Italian language certification) certifying bodies \u2013 which may be in partnership with the local Italian Cultural Institutes \u2013 are only the\u00a0<strong>Universit\u00e0 per stranieri di Siena, Universit\u00e0 per stranieri di Perugia, Universit\u00e0 Roma Tre and Societ\u00e0 Dante Alighieri<\/strong>.<\/li>\n<\/ol>\n<p>In\u00a0<strong>NSW<\/strong>\u00a0the following institutions\u00a0<a href=\"https:\/\/www.coasit.org.au\/services\/education-services\/italian-certification\/\"><strong>Co.As.It<\/strong><\/a>\u00a0and\u00a0<a href=\"http:\/\/www.cnansw.org.au\/cna-marco-polo-school.htm\"><strong>Marco Polo School<\/strong><\/a>\u00a0conduct the examinations.<\/p>\n<p>The following categories are not required to submit the certificate of Italian language knowledge:<\/p>\n<ol>\n<li>Foreign nationals (even though they are resident abroad) who have signed the \u201cintegration agreement\u201d as per art. 4 bis of Legislative Decree no. 286\/1998 Testo Unico Immigrazione (Immigration Consolidated Law);<\/li>\n<li>Holders of EU (or EC) residence permit for long-term residents as per art. 9 of the above Consolidate Law.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"4\">\n<li><strong> PROCEDURE<\/strong><\/li>\n<\/ol>\n<p><strong>STEP 1 \u2013 REGISTRATION<\/strong><br \/>\nThe applicant must register on the portal of the Ministry of the Interior (<a href=\"https:\/\/www.interno.gov.it\/it\/temi\/cittadinanza-e-altri-diritti-civili\/cittadinanza\/cittadinanza-invia-tua-domanda\">https:\/\/www.interno.gov.it\/it\/temi\/cittadinanza-e-altri-diritti-civili\/cittadinanza\/cittadinanza-invia-tua-domanda<\/a>).<\/p>\n<p><strong>Please note<\/strong>\u00a0that the email address declared on the portal when submitting the online application is considered to be the chosen contact address (art. 47 of Civil Code); it is therefore necessary that the applicant checks their email regularly, because all communications relating to their citizenship application, including requests for additional documents, appointments, notification of documents etc., will\u00a0<strong><u>ONLY<\/u><\/strong>\u00a0be sent electronically.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>STEP 2 \u2013 APPLICATION SUBMISSION (Model AE)<\/strong><br \/>\nOnce registered, the applicant can submit their application online and upload all the necessary documents on the relevant portal of the Italian Ministry of the Interior:\u00a0<a href=\"https:\/\/portaleserviziapp.dlci.interno.it\/\">https:\/\/portaleserviziapp.dlci.interno.it<\/a>.<\/p>\n<p>Any technical or content-related query must be addressed directly to the Ministry of the Interior who has set up a customer service with FAQs and dedicated Help Desk.<\/p>\n<p><strong>Please note: NOTES FOR COMPLETING THE ONLINE APPLICATION<\/strong><\/p>\n<ul>\n<li>In the registration form the applicant needs to enter the DATE AND PLACE OF BIRTH as they appear on the birth certificate;<\/li>\n<li>The PERSONAL DETAILS specified in acts and documents drawn up abroad by the competent foreign authorities must be entered. In case of discrepancies, please provide supporting documentation. For example, certificate of change of name and \/ or surname, duly legalized and translated. If there have been changes in the name and \/ or surname, the birth certificate must include the appropriate annotations and cannot have been issued for more than six months by the country where you were born.<\/li>\n<li>In the application the applicant needs to specify any minor children from a previous relationship.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>STEP 3 \u2013 CONSULAR CHECKS<\/strong><\/p>\n<p>The Consular Office will be automatically informed that the application has been submitted and will carry out the necessary CHECKS. The applicant will then receive a message through the portal of the Ministry of the Interior informing them that the application has been accepted or specifying the reason for it being unacceptable.<br \/>\nIf the application is accepted, the applicant will be invited via the portal to the Diplomatic\/Consular mission to have the signature that appears on the citizenship application authenticated, to submit all the ORIGINAL paper documentation, including those that have already been uploaded on the portal, to pay the consular fees due or to check they have been paid. All the above original documentation will be kept by the Diplomatic\/Consular mission, except for the passport and language certificate, for which a certified copy will be made and relevant fees collected.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>STEP 4 \u2013 ASSESSMENT and TIME-LIMITS OF THE PROCEDURE<\/strong><\/p>\n<p>The assessment of the application and completion of the procedure are the sole responsibility of the Ministry of the Interior: 24 months from the submission date of the application \u2013 which can be extended to 36 months at most \u2013 for citizenship applications submitted from 20th December 2020 (date of entry into force of Law no. 173 of 18th December 2020). If at the end of the assessment of the application, the procedure is completed successfully, the Ministry of the Interior will send the Italian Citizenship Decree to the Diplomatic\/Consular mission covering the area of the long-term residence of the applicant.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>STEP 5 \u2013 DECREE, NOTIFICATION AND OATH<\/strong><br \/>\nThe Italian Citizenship Decree will be notified through the portal by means of a communication sent to the email address specified by the applicant when they registered. At the time of the notification the Diplomatic\/consular mission will request the documents set out in national law with a view to ascertaining whether the marital relationship still exists.<\/p>\n<p><strong>These documents must bear a date later than the adoption date of the decree:<\/strong><\/p>\n<ul>\n<li><em>Atto integrale di matrimonio<\/em> (full marriage certificate) issued by the Italian \u201cComune\u201d (town hall);<\/li>\n<li>Criminal record certificate of the country of current residence, duly legalised and translated (see Documents section);<\/li>\n<\/ul>\n<p>At the date of adoption of the decree, no dissolution, annulment or termination of the civil effects of the marriage\/civil partnership or legal separation (separation judgment) must have occurred.<\/p>\n<p>No later than six months from notification, the applicant will be invited to the Consular Office to swear an oath of allegiance to the Republic and its laws.<\/p>\n<p>A fee (stamp duty) must be paid for the decree.<\/p>\n<p>The full marriage certificate must be requested from the Italian Comune (town hall) in where it is registered.<\/p>\n<p>The criminal record certificate is requested from the relevant authorities in the country of residence, and must be duly legalised\/apostilled, and translated, as outlined in the \u201cDocuments\u201d section.<\/p>\n<p>The applicant will swear an oath of allegiance by pronouncing the following words:\u201c<strong>GIURO DI ESSERE FEDELE ALLA REPUBBLICA E DI OSSERVARE LA COSTITUZIONE E LE LEGGI DELLO STATO<\/strong>\u201d.<\/p>\n<p>The effects of the oath, that is the acquisition of Italian citizenship, will commence the day after that of the oath.<\/p>\n<p>The original birth certificate will be sent to the relevant Italian Comune (town hall) to be registered, together with an AIRE registration request and the statement of oath.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"5\">\n<li><strong> Administrative simplification and fees<\/strong><br \/>\nIf the applicant is an EU national, they can self-certify their spouse\/civil partner\u2019s Italian citizenship, their being married to\/in civil partnership with an Italian national and the family composition.<br \/>\nInformation, details and documents already in the Public Administration\u2019s possession can be acquired <em>ex officio<\/em>, provided the applicant has given essential details to gather the necessary information (Presidential Decree 445\/2000).<\/li>\n<\/ol>\n<p><strong>Fees<\/strong>:<br \/>\nA fee of euro <strong>250.00<\/strong> must be paid to the <em>Ministero dell\u2019Interno<\/em>, only on the current account specified by the <em>Ministero dell\u2019Interno<\/em> (payment receipt to be uploaded in the online application)<\/p>\n<p>\u201cMinistero dell\u2019Interno D.L.C.I Cittadinanza\u201d<\/p>\n<p><strong>Name and address of the Bank:<\/strong>\u00a0Poste Italiane S.p.A., Piazzale del Viminale, 00184 Roma;<\/p>\n<p><strong>IBAN code:<\/strong>\u00a0IT54D0760103200000000809020<\/p>\n<p><strong>Reason for payment:<\/strong>\u00a0Richiesta cittadinanza per matrimonio ex art. 5 L. 91\/1992 + applicant\u2019s name and surname<\/p>\n<p><strong>BIC\/SWIFT Code of Poste Italiane:<\/strong>\u00a0BPPIITRRXXX (for international bank transfers);<\/p>\n<p><strong>BIC\/SWIFT Code:<\/strong>\u00a0PIBPITRA (for transactions of the EUROGIRO system)<\/p>\n<p>&nbsp;<\/p>\n<p>Articles of the\u00a0<a href=\"https:\/\/conssydney.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/consular-fees\/\">consular fee<\/a>\u00a0schedule to apply:<\/p>\n<ul>\n<li>Authentication of signature on the application: art. 24;<\/li>\n<li>Duty stamp on the application: art.
