{"id":271,"date":"2023-01-18T19:56:40","date_gmt":"2023-01-18T08:56:40","guid":{"rendered":"https:\/\/conssydney.esteri.it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/servizi-notarili\/"},"modified":"2025-01-30T08:36:38","modified_gmt":"2025-01-29T21:36:38","slug":"servizi-notarili","status":"publish","type":"page","link":"https:\/\/conssydney.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/servizi-notarili\/","title":{"rendered":"Notary Services"},"content":{"rendered":"<p>In accordance with the Italian national legislation (<em>Decreto<\/em><br \/>\n<em>Legislativo 3 febbraio 2011, n. 71 &#8220;Ordinamento e funzioni degli Uffici\u00a0<\/em><em>consolari&#8221; &#8211; Art. 28 &#8211; Funzioni notarili<\/em>), the Head of the Consular Office exercises the functions of a notary\u00a0<strong>exclusively<\/strong>\u00a0for\u00a0<strong>Italian citizens<\/strong>\u00a0who live abroad permanently or temporarily.<\/p>\n<p>The only exceptions are if a deed must be signed by both a foreign and Italian citizen, as well as Atti Notori for marriage<br \/>\nto be contracted in Italy by Australian or US citizens.<\/p>\n<p>The Consulate General of Italy in Sydney prepares documents and provides many of the services that, in Italy, would require the intervention of a notary, such as general and special power of attorneys,\u00a0<em>atti notori<\/em>, signature authentication,\u00a0<em>dichiarazioni sostitutive di atti di notoriet\u00e0<\/em>, etc. However, the\u00a0<strong>Office cannot<\/strong>\u00a0<strong>provide any legal assistance\/advice<\/strong>.<\/p>\n<p>In any case, there are local <a href=\"https:\/\/conssydney.esteri.it\/wp-content\/uploads\/2023\/02\/Elenchi-legali.pdf\">lawyers<\/a> and <a href=\"https:\/\/conssydney.esteri.it\/wp-content\/uploads\/2023\/02\/Elenchi-notai.pdf\">public notaries<\/a><br \/>\nable to draw up notarial deeds in Italian and to offer legal advice to those who need it, even towards citizens of other nationalities.
